The Swedish Agency for Digital Government (Digg) and The Swedish Authority for Privacy Protection (IMY) have presented guidelines for generative AI in public administration. The guidance aims to promote the use of generative AI and has been developed in collaboration with several actors on behalf of the government. There are 18 guidelines covering seven areas: management and responsibility, information security, copyright, data protection (GDPR), ethics, labor law and procurement.
Regarding the copyright area, it is noted that several copyright issues have arisen with the development and use of AI. The issue of AI being trained on copyrighted works and the uncertainties regarding rights and liability for AI-generated material are among those mentioned.
The guidelines on copyright are mainly about minimizing risks by, for example, deciding what may be input into a generative AI solution and how it may be instructed, and setting rules on how what is created may be used based on intellectual property rights aspects. The use of generative AI should always be done responsibly.
